By creating an account or otherwise using Ascenyo (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization (for example, a gym or training business), you represent that you have the authority to bind that organization to these Terms.

2. Description of the Service

Ascenyo is a software platform that allows personal trainers and gyms ("Trainers") to manage clients, diets, training routines, and workout progress, and allows their clients ("Clients") to view and log information related to their own training and nutrition plans.

3. Accounts and Eligibility

You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

Trainers are responsible for obtaining any consent required from their Clients before adding the Clients' personal data to the Service.

4. Subscriptions and Billing

Access to certain features requires an active subscription plan. Fees, billing cycles, and plan limits (such as the number of trainers or clients) are as described at the time of purchase and may change with notice. Suspended, past-due, or expired subscriptions may result in restricted access to the Service until payment is resolved.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulation;
  • Attempt to gain unauthorized access to other tenants', trainers', or clients' data or accounts;
  • Upload malicious code or interfere with the normal operation of the Service;
  • Reverse engineer, resell, or sublicense the Service except as expressly permitted.

6. Health and Fitness Disclaimer

The Service is a tool for organizing training and nutrition information. It is not a substitute for professional medical advice, diagnosis, or treatment. Trainers are solely responsible for the training and nutrition guidance they provide to their Clients. Clients should consult a physician before beginning any exercise or diet program, particularly if they have any pre-existing health condition.

7. Data and Privacy

Our collection and use of personal data in connection with the Service is described in our Privacy Policy. By using the Service, you consent to that collection and use.

8. Intellectual Property

The Service, including its software, design, and content (excluding data you submit), is owned by us or our licensors and is protected by intellectual property laws. You retain ownership of the data you submit to the Service.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if your subscription lapses. You may stop using the Service and request account deletion at any time, subject to any data retention obligations described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, and we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
